Stout was engaged by the New York Legal Assistance Group (NYLAG) on a pro-bono basis to analyze the compliance of administrative proceedings of students with disabilities enrolled in New York City public schools. Stout’s analysis was in connection with a class action filed by NYLAG, on behalf of students with disabilities, against the New York State Education Department (NYSED) and New York City Department of Education (NYCDOE).

Under federal law, children with disabilities are entitled to receive special education services, and when these are inadequate, they can file complaints, which need to be addressed in a timely manner. Stout analyzed data maintained by NYSED and NYCDOE to determine if the administrative proceedings were compliant with required timelines.

NYLAG relied on Stout’s quantitative analysis and written declaration in settlement negotiations and hearings. As negotiations continued, Stout periodically conducted supplemental analyses based on new data and scenarios presented and worked closely with NYLAG to ensure all parties had the most up-to-date and accurate data.

The class action ultimately resulted in a settlement agreement between the affected families and NYSED and NYCDOE. As part of the settlement agreement, the state and city’s education departments will make changes to ensure that families receive timely decisions on their complaints.
