Quantified damages due to delays in public park renovation
Stout experts prepared an expert report on behalf of a contractor that was averse to a county department of public works for uncontrollable delays and challenges caused by the county that involved the renovation and enhancement of a portion of a public park.
We quantified the contractor’s damages related to the following:
- Extended general conditions
- Owned equipment on standby
- Contractor-owned equipment used by subcontractors
- Additional costs incurred by the contractor to complete a specific scope of work after the original subcontractor was unable to due to the delays and challenges caused by the county
- Compensation for additional quantities
- Unabsorbed home office overhead
- Incremental bond costs for subcontractor bonds purchased by the contractor
- The contractor’s unearned profit and overhead on subcontractor claims
- Incremental project bond cost
- Retention withheld by the state department
Additionally, we quantified each of the five subcontractor’s damages related to costs incurred for labor, owned equipment, rented equipment, materials, subcontracts, other costs, and unpaid quantities as well as the applicable markups for the subcontractors and contractor.
