Stout was retained by counsel for a well-known coffee press manufacturer. The company identified products being sold on a popular online marketplace that were infringing its trade dress, and filed suit against the seller for trade dress infringement. Stout’s role was to offer opinions as to the profits earned by the infringer on sales of those products. Because produced sales and cost information was incomplete and internally inconsistent, the Stout expert witness prepared alternative scenarios depending on the interpretation of the source information. Ultimately, the Stout expert testified at trial, Stout’s client prevailed, and the jury awarded damages matching one of the numbers presented by the Stout expert.
