Retained in patent infringement matter related to genetically modified plants

We were retained on behalf of the patent owner to provide a damages opinion in a patent infringement matter related to a genetic modification in plants that makes the plants resistant to a particular type of herbicide.  Stout analyzed the evolving market for genetically modified plants and the relative importance of the patented technology to the sales of accused products.  Stout performed various analyses to forecast defendant’s profitability and to determine reasonable royalties under various scenarios.  The case was ultimately dismissed following a finding of non-infringement.
