Stout was retained by counsel of the advisor to a number of heirs to an estate consisting of primarily real estate assets held in trusts and various operating/non-operating entities. Our investigation entailed tracing the ownership and title to real property held in land trusts and special purpose entities that were utilized in an effort to obscure ownership. Additionally, we evaluated claims related to whether funds provided to an operating entity should be characterized as debt or equity capital. Finally, we evaluated whether and to what extent certain counter-party heirs dissipated and/or misappropriated assets, including cash and securities. Our report and subsequent testimony was instrumental in the resolution and settlement of the matter.
