Stout was retained as the rebuttal damages expert by a leading consumer electronics company that manufactured wireless whole home audio systems. The company was alleged to infringe patents of a direct competitor. Stout’s analysis included an evaluation lost profits and reasonable royalties set forth by the plaintiff's damages expert. The plaintiff's lost profits analysis was significantly reduced, and the royalty opinion was excluded in its entirety based on fundamental flaws that we identified in the analyses and conclusions. The case proceeded to trial and settled shortly thereafter.
