Stout was retained by counsel to provide opinions regarding damages resulting from breach of a license agreement between an inventor and a large furniture manufacturer. Stout received sales data spanning a 20 year period, which we compiled into a database consisting of tens of millions of rows. With the help of counsel and technical experts, we segmented out sales of licensed products, including domestic, international, wholesale and retail sales. From there, we calculated royalties owed to the inventor under the terms of the license agreement, compared the royalties owed to actual royalty payments received, and then calculated unpaid royalties due, along with interest. A jury found that the technology was incorporated into the disputed products and awarded the inventor unpaid royalties and interest in excess of $5 million, based on our expert testimony presented at trial.
