Nicole McTernan has over five years of experience providing litigation support and forensic accounting consulting services, including financial statement analysis, the application of generally accepted accounting principles, regulatory compliance, valuation, the calculation of economic damages, and the evaluation of complex accounting and financial issues, to both public and private sector clients. Nicole is responsible for leading teams in complex investigations and commercial disputes.
She has extensive expertise across a broad range of industries focusing on accounting and white-collar issues. Recent cases include evaluation and analysis of asserted economic damages resulting from an alleged partial breach of contract between multiple nuclear utilities and the United States Department of Energy, damages claimed for spoilation of manufactured food products and related remediation costs, damages resulting from an alleged breach of fiduciary duty associated with a limited partnership’s failed investment in an emerging technology company, and claims related to underpayment by insurers for medical care provided by hospital systems.
Her work frequently involves research related to U.S. Generally Accepted Accounting Principles (GAAP), Generally Accepted Auditing Standards (GAAS), and Public Company Accounting Oversight Board (PCAOB) standards. She is responsible for assisting counsel with written discovery, fact and expert depositions, trial preparation, and settlement negotiation. Nicole has also supported the preparation of numerous expert reports and has analyzed opposing experts’ reports.
She has participated in the AICPA Building and Maintaining an FLS Practice Micro-Community and is a recent graduate of the AICPA Leadership Academy.
Nicole has presented on topics including forensic accounting and litigation consulting at the University of Richmond’s Q-Camp and AccountingFest events. She has also served as a guest lecturer at the University of Richmond and James Madison University on topics including forensic accounting, fraud, and litigation consulting. As part of the AICPA’s Fireside Chat series, she moderated a conversation on emerging ESG regulation.
