In 2024, a judge in the Northern District of Indiana ruled that Forest River was entitled to enhanced damages after a jury determined that inTech Trailers willfully infringed Forest River’s trademarks on recreational vehicles. This ruling increased the original damages award from $2 million to more than $5.5 million, ensuring that inTech does not profit from its infringement.

Forest River, Inc., a Berkshire Hathaway RV manufacturer, filed suit against a competitor for infringing on two of its trademarks. The plaintiff’s counsel, on behalf of Forest River, retained Stout to assess defendant’s unjust enrichment. We testified at a jury trial in the U.S. District Court for the Northern District of Indiana. The jury returned a unanimous verdict awarding Forest River $2 million and finding that the defendant had willfully infringed its trademarks. The Court also awarded prejudgment interest based on our analysis.
