Stout was engaged to provide expert opinions and arbitration testimony in a dispute involving alleged monetary relief owed to a lender service provider following a breach of contract by a lender participating in the Paycheck Protection Program (PPP). The dispute centered on the allocation and payment of fees owed under the Small Business Administration (SBA) loan program.

Our scope of work included the comprehensive review and analysis of a wide range of financial and contractual documents, including service agreements, lender participation contracts, SBA-related documentation, detailed loan files, banking records, and supporting invoices. Based on this analysis, we prepared an expert report quantifying the unpaid SBA fees and calculating accrued interest owed to the lender service provider.

In addition to our affirmative damages analysis, we were also retained to review, assess, and rebut the findings and conclusions of the opposing party’s expert. This included evaluating claims of incremental costs incurred, additional damages asserted, and other financial assumptions made in their analysis. Our work supported our client’s position by identifying methodological flaws, unsupported assumptions, and inconsistencies in the opposing expert’s calculations.

Our findings were presented in expert reports and arbitration testimony, helping to clarify the financial implications of the contract breach and assist the trier of fact in understanding the damages and cost recovery issues. The trier of fact ultimately found in favor of our client and awarded the claimed damages.
