Stout was engaged by the Plaintiff in a tort and legal malpractice claim which arose as the result of a corporate M&A transaction. Stout's client claimed it was provided incorrect legal advice which resulted in the absorption of substantial unforeseen liabilities. These liabilities caused severe financial threats to both the company's short-term liquidity and long-term solvency. Stout provided profitability and viability analyses for comparable companies in the client's industry, as well as an analysis of the company's financial condition with and without the liabilities which resulted from the alleged legal malpractice. Stout issued an expert report for the matter and provided testimony at deposition. Stout's work led to favorable settlement to the client.
