Our team performed an analysis and prepared an expert report for an owner of a California healthcare facility, which was damaged due to architect-caused delays that prevented the contractor from achieving substantial completion of each phase of the project. We quantified damages related to the following:
- Incremental costs incurred and paid to the contractor and its subcontractors working on the project
- Incremental costs incurred and paid to service providers engaged by the owner during the design and construction of the project
- Incremental costs incurred and paid to the owner’s employees providing construction project management and oversight services for the owner during the construction of the project
- Loss of use of the project due to the delay in opening the facility as scheduled, which resulted in lost investment income due to the owner being required to fund its construction bonds’ principal and interest payments during the periods of delay attributed to the architect, with its funds under investment
Additionally, we rebutted the contractor’s claims against the owner.
