Stout was retained by a supplier of DNA diagnostic kits in a trademark infringement suit against a much larger competitor. We were asked to measure the opposing party’s profits resulting from improper use of the accused infringing trademark and to determine our client’s actual damages in the form of corrective advertising. The case settled prior to trial.
