Stout was retained by outside counsel of a leading footwear and apparel company to serve as the damages expert for a trademark and trade dress infringement matter relating to the manufacture and sale of athletic shoes. Our work involved reviewing both the plaintiff’s and defendant’s financial production, deposition testimony, and marketing materials to determine a disgorgement of profits opinion. Ms. Fisher issued three expert reports on this matter related to damages and in rebuttal of the opposing experts’ opinion. The case ultimately settled after the issuance of expert reports and completion of expert depositions.
