Stout was engaged to analyze the alleged lost profits associated with defective products supplied to the United States military for support of troops in foreign deployments. The allegations of the plaintiff were associated with costs necessary for remedying the defect and potential lost profits associated with contract termination. Stout’s expert considered facts and testimony regarding whether there were other circumstances that may have led to product defects and deteriorating customer relations that were unrelated to the actions of the defendant. In addition, Stout considered various financial records of the plaintiff in assessing the actual costs incurred and the incremental costs of production. The matter was resolved after the deposition of Stout’s expert.
