Stout was retained by counsel for the plaintiff in a false advertising matter involving skin cream products sold through an online webstore. In particular, the defendants in the case were accused of creating fake review sites, which purported to provide independent review of skin cream products. However, the reviews were all authored by the defendants and universally displayed lower “scores” for the plaintiff’s products than for the defendant’s competing products. In this assignment, Stout analyzed web analytics, which identified declines in visits and conversion rates to the plaintiff’s online webstore during time periods in which the fake review sites were active. Stout then used that data to compute the plaintiff’s lost profits resulting from lost sales during the periods in which the fake review sites were active.
