The plaintiff’s counsel retained Stout to analyze certain accounting, financial, marketing, and other business data in order to identify the form and amount of damages that would be appropriate for the plaintiff to receive in the event that liability was found against a defendant accused of infringing two patents. In order to assess damages in this case, we relied upon the legal filings and pleadings related to the case, financial records, sales records, license agreements, marketing and promotional materials, depositions, and publicly available information such as third-party research reports. Stout prepared a detailed expert report that summarized our analysis and opinions regarding damages adequate to compensate the plaintiff. Our report was submitted to the court in support of the plaintiff’s damages case.
