Stout was retained on behalf of the defendant, a large developer and manufacturer in the life science research space, to rebut and quantify damages in a patent infringement matter. The technology at issue related to microarrays used for detecting genetic variation, among other things. Stout rebutted the damages quantification performed by the plaintiff’s expert and also put forth an alternative damages calculation by analyzing the importance of the allegedly patented technology. After the filing of expert reports, the matter settled for Stout’s client.
