Stout Expert Testimony Supports Navistar Victory in $16.5 Million Dispute

Stout Managing Director Mark Hosfield provided economic damages testimony on behalf of defendant Navistar Inc. in a federal lawsuit involving allegations against Navistar of delayed truck deliveries. A jury in the U.S. District Court for the Eastern District of Michigan found in favor of Navistar, rejecting the plaintiffs’ breach of contract and fraud claims.

GLS Leasco Inc. and Central Transport LLC sought $16.5 million in damages related to the production and delivery of 1,100 trucks ordered from Navistar. The plaintiffs alleged that delays prevented them from selling older trucks before used truck values declined. After a three-week trial and more than eight hours of deliberation, the jury determined that the plaintiffs had not established their claims.

Hosfield served as Navistar’s economic damages expert. His testimony addressed the plaintiffs’ claimed losses and the business decisions affecting the timing and value of their used-truck sales. Hosfield testified that the plaintiffs’ losses resulted from their business decisions rather than the timing of Navistar’s deliveries.

“Damages analysis requires a careful examination of the decisions and market conditions that contributed to the claimed loss,” Hosfield said. “In this matter, our work focused on separating the economic impact of the alleged conduct from other factors that affected the plaintiffs’ results.”

Hosfield has extensive experience providing consulting and expert witness services in commercial disputes. His work includes analyses of lost profits, economic damages, incremental profits, price erosion, business interruption, and other financial issues.
