Stout was hired by a medical device manufacturer seeking a permanent injunction against a party that it alleged of infringing a portfolio of patents relating to devices used in a neonatal intensive care setting.  Stout evaluated the economic factors identified by the Supreme Court in eBay v. MercExchange as being relevant to a permanent injunction. Stout’s expert opined that, from a financial and economic perspective, these factors weighed in favor of a permanent injunction and supported those opinions in two expert reports and a deposition. The case settled prior to trial.
