Defense counsel retained Stout to provide opinions regarding damages due to a patent owner, assuming infringement of a patent related to a hidden storage system in pickup trucks. Stout also reviewed and analyzed an opposing expert’s report and provided opinions regarding his methodology and conclusions. Stout reviewed the record evidence and determined that reasonable royalties were an appropriate measure of monetary relief to compensate patent owner for defendant’s alleged infringement of the asserted patents. Within our reasonable royalty analysis, we quantitatively assessed a range of royalty amounts using the commonly accepted market, income, and cost valuation approaches. We then provided a qualitative analysis using the framework outlined by the Georgia-Pacific factors. Stout concluded that the parties would have agreed to a range of royalty amounts based on the defendant’s incremental profits. The parties settled the dispute prior to trial.
