Stout was engaged to provide an opinion regarding the damages due to a provider of software and related services as a result of the breach of contract and misappropriation of trade secrets by a customer that used its software to provide electronic payment services. Stout provided a damages opinion based on the profits the software/service provider would have generated but for the breach and/or misappropriation. Our work involved reviewing numerous documents including historical agreements between the parties, and then projecting five to ten years of revenues that would have been generated as well as the associated costs to arrive at our opinion of the profits lost by the plaintiff. We also provided rebuttal opinions with regard to the report set forth by the opposing damages expert. Our work played an important role in the parties reaching a settlement prior to trial.
