Stout was engaged by a provider of representations and warranties insurance to provide expert services for a dispute with an Insured in JAMS arbitration. The dispute arose from alleged breaches of the representations and warranties in a private equity fund’s purchase of a company providing energy and telecommunications infrastructure maintenance and repair services. The claimant alleged breaches of the financial statement representation, primarily relating to duplicate revenue recognition and failure to properly reserve for uncollectable accounts receivable. Stout assisted our client with discovery, deposition preparation, and a forensic investigation of the documents produced. We also provided multiple expert reports and testimony at deposition, offering rebuttal opinions on the fact of breach as well as the valuation of the alleged loss. Based in part on our report and testimony, our client received a favorable ruling from the arbitration panel.
