Stout was hired as expert by a tier 1 automotive supplier to rebut alleged damages claimed by a financial institution in its capacity as a secured creditor of one its suppliers, a metal stamping company. The dispute related to amounts allegedly due pursuant to an agreement to globally resolve accounts payable from our client to its supplier through a reconciliation process with included, among other things, a series of payments, credits and consigned steel. We rebutted the plaintiff’s damage claim based on our analysis of all of the transactions between the parties during the time period at issue, including those not included in the reconciliation process. We concluded the amount payable by our client was approximately $1,000 as opposed to the $500,000 claimed by the plaintiff. The matter settled prior to the taking of expert depositions.
