Provided analysis for theft of trade secrets related to the manufacturing of retail and consumer products

Stout was engaged by the Defendant, a diversified global manufacturer, in a case regarding the theft of trade secrets. Stout's efforts began in the early stages of litigation with the assistance of discovery. As the litigation strategy developed, cost accounting and profitability analyses were performed to allocate profits to the variety of features on the parts manufactured by the defendant. Thereafter, Stout provided the client with various analyses regarding the alleged theft of trade secrets such of lost profits and disgorgement of profits. Stout also prepared a reasonable royalty analysis simulating hypothetical negotiations and assisted the client with contract management. After discovery and the production of the analysis, Stout prepared an expert report (Rule 26 Federal Report) and provided deposition testimony. The work provided resulted in a favorable settlement to Stout's client prior to trial.
