We were engaged to provide expert testimony on behalf of a Danish plaintiff regarding damages resulting from a breached contract by a major ERP software provider. The Plaintiff had provided proprietary information to the software provider with the expectation of the information being provided to clients in a separately priced module. When the information was bundled with other free modules and given out to all clients without charge, the economic value of the information and the opportunity for incremental licensing fees was lost. Stout analyzed comparable licensing information, industry data on ERP system installation costs and benefits, and worked in conjunction with a technical expert to develop an opinion of lost profit damages and an alternative opinion of unjust enrichment damages. The case settled prior to deposition with a favorable outcome for the Plaintiff.
