Stout was engaged by the Defendant, a diversified global manufacturer, in a matter regarding the theft of trade secrets. Stout’s engagement team began in the early stages of litigation with providing assistance in discovery. As the litigation strategy developed, cost accounting and profitability analyses were performed to allocate profits to the variety of features on the parts manufactured by the defendant. Thereafter, Stout provided the client with various damage analyses regarding the alleged theft of trade secrets, such as lost profits and disgorgement of profits. Stout also prepared a reasonable royalty analysis. After discovery and the completion of the analysis, Stout prepared an expert report (Rule 26 Federal Report) and provided deposition testimony. The services provided resulted in a favorable settlement for Stout’s client prior to trial.
